Rights of Nature: legal perspectives from Latin America, and its implications in International Environmental Law

Rights of Nature are emerging to change the scope of how environmental issues are dealt with. They pose a paradigm shift about legal foundations regarding objects and subjects. Mainly, America has proved that bestowing rights to Mother Earth is not a folklorist concept, rather it demonstrates a possible path to improve environmental protection.

The session will describe how various American States have recognised the Rights of Nature. It will depict the different legal approaches taken to bestow Mother Earth with Rights (constitutional framework, legal acts and judicial awards). Then, it will review whether the international arena has participated in the evolution of this set of rights. It will focus on the Inter-American Court of Human Rights´ Advisory Opinion “OC-23/17” about the Environment and Human Rights.
